Terms & Conditions

1. General
1.1
These Terms and Conditions (T&Cs) regulate the contractual relationship entered into between LJUS STUDIO ZÜRICH/CARLA ARAOS (classes, workshops, retreats and all activities organised by Carla Araos) and the customer. The customer has read these terms and conditions (https://carlaaraos.com/legal-notice/ ) and has confirmed their consent. 

1.2
Sections 5, 6, 7, 8 and 9 of these T&Cs also extend to all classes and services offered by all other teachers at LJUS STUDIO. For the full T&Cs for these teachers, please contact them directly.

1.3
Subsequent changes or additions to these T&Cs will be published on LJUS STUDIO ZÜRICH’s website. They become part of the contract if the customer does not object to the changed T&C within 30 days of becoming aware of them.

2. Scope of services
2.1
The services include the implementation and organisation of yoga classes, workshops, retreats, birth preparation, studio rental as well as non-mentioned contracts that are related to the business activities mentioned.

2.2
The current schedule of classes/workshops/retreats and special events can be found at www.ljus-studio.com / https://www.eversports.ch/widget/w/bguhpM and are subject to change without prior notification. Participants that have a class reservation will be informed of any changes to the schedule that directly affect their class booking.

2.3
The studio will be open fifteen minutes before the class starts. Students are advised to arrive within that time. The opening times stated in Google Maps are based on the current schedule, but will not be updated in case of short term changes/cancellations.

3. Costs, prices and terms of payment
3.1
The current costs for yoga classes, workshops and special events can be found at www.ljus-studio.com

3.2
Full payment for yoga classes/passes is made before the class begins. Unless otherwise agreed or specified, payment is made before the class/first day of the event via Eversport GmbH online via https://www.eversports.ch/widget/w/bguhpM.

4. Terms and conditions of reservations and cancellations
4.1 Passes
The yoga passes expire after their validity date, are personal and non-transferable. The yoga passes are valid from the date of purchase.
Paid service fees for passes will not be refunded. In the event of illness or an accident, the duration of all passes can be paused accordingly, upon presentation of a doctor’s certificate. Changes in the schedule or in the teacher can be made at any time. There is no entitlement to a refund if a class is taught by a substitute teacher.

4.2 Reservation regulations
Online reservation is mandatory for all classes with CARLA AROAS via Eversport GmbH at https://www.eversports.ch/widget/w/bguhpM. LJUS STUDIO ZÜRICH/CARLA ARAOS cannot guarantee free spots in the scheduled classes if attended without prior reservation.

If the class is full, the student will be placed on a waiting list. The booking through the waiting list is binding and the cancellation policy stated below is applicable.

4.3 Cancellation by participants
Once a reservation has been made, it can be cancelled up to 2 hours before the start of the class via the online reservation system (website or app) offered by Eversport GmbH. Registrations and cancellations by phone or email cannot be considered.

In the case of late cancellations (less than two hours before the class starts) and no-shows, the class will be deducted from the subscription without notification. For classes paid for individually, the paid amount will not be refunded. Classes that are pending payment must be paid in full.

4.4 Cancellation by LJUS STUDIO/CARLA ARAOS / change of teacher
In the event of illness or unplanned events, LJUS STUDIO ZÜRICH/CARLA ARAOS reserves the right to cancel the yoga class, even at short notice, or to arrange a qualified substitute teacher. The customer will be informed of a cancellation/change as soon as possible by e-mail, SMS or telephone (with the exception of unforeseeable cancellations).

4.5 Minimum number of participants
Group yoga classes are carried out depending on the minimum number of participants. If the minimum number of participants is not met, the class will be cancelled. If a class cannot take place due to a lack of participants, the paid amount can be used as credit for an alternative class with Carla Araos. The payment will not be refunded. For classes reserved with a pass, the pass will not be deducted.

If a class is cancelled due to a lack of participants, all participants already registered will receive a cancellation email up to two hours before the start of the class.

4.6 Cancellation of classes and opening times
If a scheduled class or event cannot take place, LJUS STUDIO may remain closed for the duration of the class or event. The online opening times of the studio in this instance are no longer applicable.

4.7 Cancellation policy for workshops/masterclasses/retreats/trainings/events
Registrations for workshops/Masterclasses/retreats and trainings are binding. The costs are also due in the event of no-show. It is possible to find a replacement person in advance: The replacement person must be reported by email, stating their last name/first name and email address.

Cancellations involve administrative work and must be communicated to the provider by email. If a participant withdraws from a workshop/masterclass/day or urban retreat (in Ljus Studio), the following conditions apply:

– Cancellation up to 15 days before the start of the course: A full refund is given.
– Cancellation up to 3 days before the start of the course: A 50% refund is given.
– Cancellation less than 3 days before the start of the course: No refund possible.

If a participant withdraws from a retreat (external location), the following conditions apply:

– Cancellation up to 16 days before the start of the retreat: A 50% refund is given.
– Cancellation 15 to 4 days before the start of the retreat: A 25% refund is given.
– Cancellation less than 3 days before the start of the retreat: No refund possible.

No exceptions to the aforementioned refund policy for workshops/masterclasses/retreats/trainings/events can be made, regardless of the reason for the cancellation.

Workshops/masterclasses/retreats and trainings are carried out depending on the minimum number of participants. These are listed in the advertisement. If an event cannot take place due to a lack of participants, all previously paid amounts will be refunded.

4.8 Cancellation policy for private classes
Booked appointments for private classes or birth preparation course must be cancelled or re-scheduled more than 24 hours before the agreed appointment. For cancellations made less than 24 hours before the start of the class/course, the full class/course amount is due and no refund is possible.

5. Eligibility
5.1
Participants must complete an online registration or registration form before participating in yoga lessons. By accepting the terms and conditions, the participant confirms that there are no health concerns preventing participation in yoga courses/events/workshops. All courses require personal responsibility. In the case of acute physical or psychological problems, it is the responsibility of the participants to consult their doctor before participating in the courses/events/workshops, whether yoga is allowed to be practiced. Yoga classes can have an effect on physical, mental and psychological well-being. Yoga classes do not constitute medical or psychotherapeutic treatments

Existing mental or physical health restrictions as well as an existing pregnancy must be reported to LJUS STUDIO ZÜRICH/CARLA ARAOS or the teacher present, at the latest at the beginning of the event. 

The participants must follow any protective measures (e.g. Corona) introduced by the federal government, canton or LJUS STUDIO ZÜRICH/CARLA ARAOS, otherwise they cannot participate in the yoga classes, workshops and events. A refund of the paid fee is not possible. 

6. Liability
6.1
The organiser LJUS STUDIO ZÜRICH/CARLA ARAOS and the teachers at LJUS STUDIO accept liability for the proper implementation of the courses/events/workshops within the framework of the statutory warranty provisions. Any further liability, in particular under the heading of compensation for damages, is expressly excluded. The organisers therefore assume no liability of any kind, in particular no liability in the event of concealment of any physical or mental illnesses that make participation in the yoga events/workshops seem inadvisable.

LJUS STUDIO ZÜRICH/CARLA ARAOS and the teachers at LJUS STUDIO reserve the right to reject participants if it is deemed that the health or psychological requirements for participation in the classes are not met. This refusal can also be made at short notice or even during ongoing classes. In the event of rejection, the class fee (pro rata) will be refunded.

6.2
The use of the course premises and offers is at the participants’ own risk. No liability is accepted for valuables brought by participants.

6.3
For all yoga classes and events organised by LJUS STUDIO ZÜRICH/CARLA ARAOS and teachers at LJUS STUDIO, we exclude any liability for damage incurred. Participants are responsible for sufficient insurance cover (accident, theft, loss of objects, etc.). LJUS STUDIO ZÜRICH/CARLA ARAOS and all teachers at LJJUS STUDIO cannot be held responsible for theft or loss of items.

7. Prices
7.1
All prices are gross prices in Swiss Francs. Price changes, misapprehension and errors are excepted. Prices are binding as applied at the time of the order.

8. Data protection
8.1
Protecting your privacy is important to us. LJUS STUDIO ZÜRICH/CARLA ARAOS and the teachers at LJUS STUDIO undertake to treat personal data and information confidentially and not to pass them on to third parties. An exception to this is the transfer of data to teachers and business partners for organisational reasons. The participants also undertake to treat information about other course participants as confidential.

9. Copyright
9.1
The copyright and all other rights to content, images, photos or other files on LJUS STUDIO ZÜRICH’s website and other media belong exclusively to the provider. Written consent from the copyright holders must be obtained in advance for the reproduction of the elements. Violations will be prosecuted and oblige to pay damages.
